Rep.Matt Gaetz 38, a prominent Republican Congressman from Florida was facing demands last night that he either resign or be removed from his position on the House Judiciary Committee after the New York Times broke a story on Tuesday that Gaetz was under DOJ investigation for alleged sexual trafficking offences involving a 17 year old girl.

The story dates back to another DOJ investigation in August 2020 when a close friend of Gaetz called Joel Greenberg was arrested and indicted for the sexual trafficking of minors in Seminole Florida. Greenberg who had been elected as a County Tax Inspector in 2016 was also charged with fraud, harrassment of a political rival, improper use of state DVLC databases, forgery, identity theft, and impersonating a police officer.

Rep. Matt Gaetz gave an interview to Tucker Carlson on the Fox TV channel on Tuesday during which Gaetz tried to alter the narrative by stating that he was the victim of an extortion attempt by a former Florida DOJ official called David Mcgee. Gaetz claimed that his family had been approached on 16 March with a demand for $25 million, and that his father had been asked to wear a wire recording device by the FBI.

At one point Matt Gaetz tried to enlist Tucker Carlson as a character witness by suggesting that Carlson would remember another young lady he had brought to dinner at the Carlsons a couple of years ago who had similar tales of ‘deep state’ extortion attempts. Tucker Carlson pursed his lips and replied carefully that he had no recollection of any such lady or dinner date, and swiftly cut to a commercial break. On his return, Carlson said his encounter with Gaetz was “the weirdest interview he had ever done”.

Gaetz actually manged to implicate himself in several other forms of potential criminal exposure too, by referring to allegations of “pay to play”, and “incriminating photos” - none of which have formed any part of the public reporting to date.

The DOJ and FBI have declined to comment publicly on any aspect of this story to date, but a couple of points stand out. First, the investigation into Gaetz’s friend Joel Greenberg began last summer in 2020 during the Trump administration when William Barr was the Attorney General in charge of the DOJ. Earlier that year Barr had issued a DOJ memorandum advising that no criminal investigations involving prominent politicians were to be opened in an election year without his personal sign-off.

Second, is that nothing in Gaetz’s counter-narrative of an alleged extortion attempt speaks to whether or not he had any involvement with his close friend Greenberg’s alleged sexual trafficking offences with a 17 year old girl. In Florida it happens to be a felony offence for anyone aged 24 or over to have a sexual relationship with a 17 y/o minor.

One final point is that this affair throws new light on the fact that back in 2017 when he was newly elected to Congress, Rep. Matt Gaetz was the only member of the house to vote No against a bi-partisan bill intended to raise the criminal penalties for the sexual trafficking of minors across state lines.

A 'Cease and Desist' letter from J.K. Rowling can't be very far away either, it would seem.

The private GOP chat-group that curated tales of these Quidditch-inspired antics was first leaked to the Business Insider news site - (Which happens to be pay-walled).

The silence of all those GOP lambs who would normally have rather a lot to say about the importance of family values, and the purity of their own party's sexual mores is getting to be rather deafening.

The New York Times reported yesterday that Congressman Matt Gaetz sought a pre-emptive blanket pardon for himself from President Trump in late November 2020.

The pardon requested by Gaetz was un-targeted, i.e. it was supposed to cover any unspecified crimes committed by him during his entire life. He also apparently asked for similar pardons for a number of other close Congressional allies too. The White House turned him down.

Legal historians have been quick to point to a well-defined Supreme Court precedent in the case of Burdick v. United States 236 U.S. 79 (1915).

In this unusual case, George Burdick city editor of the New York Tribune was imprisoned after refusing to accept an unsolicited unconditional pardon issued to him by US President Woodrow Wilson. The pardon was a legal maneuver intended to force Burdick to testify before a grand jury that was investigating whether any Treasury Department employee was leaking information to the press.

George Burdick was was fined $500 and imprisoned after refusing to accept the pardon or testify, and taking the Fifth Amendment to protect his newspaper’s sources.

The SCOTUS susbsequently ruled that Burdick was entitled to reject the unwanted pardon because acceptance would have been an implicit admission of guilt. As Burdick was entitled to reject the pardon, he was also entitled to assert his right against self-incrimination under the Fifth Amendment.

The dictum of the court’s opinion was that “a pardon carries an imputation of guilt, acceptance a confession of it”.

And that in a nutshell summarizes the problem Matt Gaetz now faces. No-one asks for a pardon unless they already think they might be guilty of a criminal offence, or likely to be charged with one.

According to a copy of a letter obtained by The Daily Beast, Joel Greenberg who was already under indictment for the sexual trafficking of minors in Florida subsequently wrote to Trump ally and fixer Roger Stone, and offered him $250,000 for his help in obtaining a presidential pardon last December.

In this confessional letter Greenberg allegedly admits that both he and Matt Gaetz had paid for sex with a number of young women, including one girl who turned out to have been only 17 years old at the time.

Roger Stone a convicted felon who had received a presidential pardon himself not long before, allegedly replied to Greenberg urging him to wire the $250,000 in Bitcoin as soon as possible.

Roger Stone had apparently taken the precaution of using an encrypted onlline messaging service called Signal to handle these sensitive discussions, and had also taken the precaution of setting his Signal app preferences to auto-delete such messages just 10 seconds later. Unluckily for him Joel Greenberg chose to screenshot the Signal messages between him and Roger Stone before they were auto-deleted.

If you are a Go player and happen to be familiar with the concept of Atari or multiple jeopardy in that game, then you will be aware that rather a lot of ’Stones’ are now about to come off the board all at once.

If substantiated, this confessional letter will instantly convict Joel Greenberg and Matt Gaetz on charges of sexual trafficking and campaign finance violations inter alia, and it will also send Roger Stone back to jail (along with Greenberg and Gaetz) on bribery charges for corruptly attempting to buy a presidential pardon.
